This webpage presents information regarding the “Compliance Review Report: C-0006-Nicaragua: GCF Project FP146: Bio-CLIMA: Integrated climate action to reduce deforestation and strengthen resilience in BOSAWÁS and Rio San Juan Biospheres” by the Independent Redress Mechanism. It includes the Secretariat management response, which was requested by the Board in decision B.34/23, paragraph (c)(i) and is being published pursuant to the following decision of the Board at its 36th meeting.

Board decision in respect of “Compliance Review Report: C-0006-Nicaragua: GCF Project FP146: Bio-CLIMA: Integrated climate action to reduce deforestation and strengthen resilience in BOSAWÁS and Rio San Juan Biospheres” (the “Compliance Review Report”) 

On 13 July 2023, at its thirty-sixth meeting, the GCF Board took a final decision (decision B.36/17) in respect of the Compliance Review Report submitted to the Board by the GCF’s independent redress mechanism, thereby concluding its consideration of the matter.  

The compendium of decisions taken by the Board at its thirty-sixth meeting, which will include the full text of the decision, is being cleared for publication and will be made available on the GCF website in the coming days.

Pending the release of the final decision text, the GCF is making available to the public a summary of the final decision as set out below. 

After considering the Compliance Review Report, and a management response requested by the Board in decision B.34/23, the Board, among other things: 

1. Took note of the actions taken by the Secretariat under the relevant legal agreements with the accredited entity to address the instances in which the development of the funding proposal for FP146 was determined by the Secretariat not to be in compliance with the policies and procedures of GCF; 
2. Affirmed the right of the Secretariat to exercise GCF’s rights under the relevant legal agreements in the event that such policy non-compliance is not addressed to the satisfaction of the Secretariat; 
3. Decided, in light of the foregoing, to conclude its consideration of the Compliance Review Report; and 
4. Requested the Secretariat to continue to suspend its review of the monitoring framework provided by the accredited entity in connection with the Board conditions set out in decision B.27/01, annex I (List of conditions and recommendations) in respect of FP146, until the accredited entity has addressed the instances of policy non-compliance to the satisfaction of the Secretariat in a manner consistent with the relevant legal agreements. 

In taking these decisions, the Board has ensured that no disbursements will be made by GCF in respect of this project until all relevant policy non-compliance has been satisfactorily addressed. 

In addition, and pursuant to paragraph 5.2 of the Guidelines to facilitate Board consideration of Independent Redress Mechanism reports on reconsideration requests, grievances or complaints, the Board provided the Reasons for its decision. The Reasons are also available on the GCF website.
